The Ministry of Construction has issued a regulation concerning cars, which will take effect from July 1st, 2026 in Vietnam.
The ministry issued Document No. 6412/BXD-KHCNMT&VLXD, providing guidance on the implementation of registration procedures for conformity assessment activities, certification, and declarations of conformity for child safety equipment used in cars under QCVN 123:2024/BGTVT. The Ministry of Construction stated that, prior to July 1st, 2026, declarations of conformity for child safety equipment used in cars will be implemented in accordance with QCVN 123:2024/BGTVT.
According to Section 3.1.2 of the regulation, child safety equipment must be declared compliant at the local specialised agency where the organisation or individual has registered its production and business activities. This must be based on conformity certification results issued by a certification organisation designated by the Vietnam Register in accordance with regulations.
From July 1st, 2026, product and goods quality management will be implemented in accordance with Law No. 78/2025/QH15, which amends and supplements several articles of the Law on Product and Goods Quality, as well as Decree No. 37/2026/ND-CP.
Under the framework, products and goods will be managed according to three risk levels: low, medium, and high. Quality management measures, conformity certification requirements, and certification entities will be determined according to the corresponding risk classification.
During the period in which the Ministry of Construction issues a list of risk classification levels for products and goods under its management, organisations and individuals involved in the production, import, and trade of child safety equipment used in cars, as well as conformity assessment organisations, are required to prepare conditions, capabilities, and documentation to conduct certification and declarations of conformity under QCVN 123:2024/BGTVT once the legal basis and required conformity assessment conditions are in place.
Conformity assessment organisations intending to conduct testing and certification activities for child safety equipment used in cars under QCVN 123:2024/BGTVT are responsible for reviewing their capabilities, operational scope, human resources, testing equipment, quality management systems, and business conditions for conformity assessment services in accordance with the Investment Law, the Law on Standards and Technical Regulations, and Decree No. 22/2026/ND-CP dated January 16th, 2026.
These organisations must organise conformity assessments for the registration of testing and certification activities under QCVN 123:2024/BGTVT at the local Department of Construction where their head office is located, following the procedures specified in Decree No. 22/2026/ND-CP.
After receiving a Certificate of Registration of Activities covering the scope of QCVN 123:2024/BGTVT, organisations seeking appointment to perform conformity certification must submit dossiers to the Vietnam Register Department for review and appointment in accordance with the regulation and relevant authority.
If a product is classified under the medium-risk category according to the list issued by the Ministry of Construction, conformity certification will be conducted by a recognised certification organisation in accordance with regulations.
If a product is classified under the high-risk category, conformity certification must be conducted by a certification organisation designated by a competent authority. Conformity assessment organisations are required to monitor risk classification lists to ensure compliance with the corresponding management requirements.
Organisations and individuals involved in the production, import, and trade of child safety equipment used in cars are responsible for understanding technical requirements, conformity assessment methods, conformity declaration dossiers, labelling requirements, and post-conformity declaration responsibilities under QCVN 123:2024/BGTVT and laws governing product and goods quality.
Before products are introduced to the market, businesses must complete conformity certification and declarations of conformity in accordance with regulations. They must also select testing and certification organisations whose operational scope complies with QCVN 123:2024/BGTVT and meets the recognition and designation requirements corresponding to the product's risk classification.
Businesses are responsible for the legality, completeness, and accuracy of dossiers, technical documents, and the quality of products placed on the market.
The Ministry of Construction has requested that the People's Committees of provinces and cities direct their Departments of Construction and relevant specialised agencies to organise the receipt and processing of dossiers for the registration of conformity assessment activities under QCVN 123:2024/BGTVT for conformity assessment organisations operating within their jurisdictions, in accordance with Decree No. 22/2026/ND-CP. These authorities will also receive dossiers for declarations of conformity for child safety equipment used in cars in accordance with regulations.
The Ministry of Construction has assigned the Vietnam Register to prepare professional conditions, provide guidance on dossier requirements, and organise the receipt and processing of registration dossiers submitted by certification organisations seeking designation under QCVN 123:2024/BGTVT within its authority. The ministry stated that the review and designation process must be conducted in accordance with regulations to meet business demand for conformity certification once all required conditions have been fulfilled.
